Homicide case allowed to continue despite evidence being sold to officer

ST. CROIX - A V.I. Superior Court judge has denied a motion to dismiss vehicular homicide and other charges against a man whose truck was being held as evidence but disappeared from police custody.

However, Superior Court Presiding Judge Darryl Donohue Sr. also ruled that measurements and pictures taken of Keith Milligan's missing silver Nissan Frontier are excluded from being used during Milligan's trial. DNA evidence collected from the truck is permissible to use in court, Donohue ruled.

The truck has since been repaired and resold.

Milligan, of Estate White Lady, was charged in connection with the August 2009 death of 53-year-old August Alcindor. Police said Milligan was driving drunk on Aug. 15, 2009, when he lost control of the pickup truck and swerved onto the shoulder of Melvin Evans Highway near William's Delight, hitting Alcindor.
